Buying Property in Baja California Sur, Mexico

In recent years, property in Mexico in general and the Baja California Peninsula in particular has become an attractive location for snowbirds seeking vacation or retirement homes and for developers looking for a safe and profitable place to invest. The Mexican government recognizes that it is essential to make owning property in Mexico safe and easy for foreigners and has rules established regulations to protect the non-Mexican buyer.

To provide a little background on this issue, the Mexican constitution of 1917 prohibits foreigners from purchasing or owning real estate within 60 miles of an international border or 30 miles of a coastline. This area is referred to as the “restricted zone”. The entire Baja California peninsula falls within its limits. Initially this prohibition made it difficult for foreigners to acquire property in the “restricted zone”.

A new, secure legal mechanism was required to permit the acquisition of property in this area by foreigners was needed. The creation of an instrument called the "Fideicomiso" or Bank Trust, was the answer. The Fideicomiso provides a safe method for foreigners to purchase and enjoy property in the restricted zone. This

Mexican property trust is much like an estate trust giving a foreigner full benefits of property ownership, even tough the actual property title is held in trust by the bank.
